This week, I was proud to lead 52 of my colleagues on a letter to President Biden raising the alarm about his sudden decision to eliminate Title 42.
Title 42 is an essential public health measure that has been in effect since the onset of the pandemic in March 2020. It grants the Department of Homeland Security the ability to immediately expel migrants that would typically be released into the country or detained in Border Patrol facilities if they are thought to pose a threat to public health.
The Administration utilized Title 42 through all stages of the pandemic, including in January 2022, when daily COVID-19 deaths were averaging 2,000, as well as July 2021 when average daily deaths were around 215. Rescinding Title 42 at a time when our country is experiencing an average of around 500 daily deaths makes little sense.
Because the Biden Administration suspended numerous effective policies that had created a more secure border, such as construction of the border wall system and the Migrant Protection Protocols, Title 42 is currently the last remaining tool at the disposal of Border Patrol agents to deter illegal migration.
Additionally, by announcing the specific date Title 42 will be removed — May 23, 2022 — human smugglers have now been given ample time to prepare to transport migrants to the border upon the termination of Title 42.
This course of action is particularly disturbing because President Biden is actually empowering Mexican drug cartels while he further cripples Border Patrol. I refuse to sit by idly.
This announcement of the end of Title 42 will likely result in an unprecedented surge of illegal migrants to the border at a time when Border Patrol is already understaffed and overworked.
One Border Patrol agent said they are “expecting to get wrecked” if President Biden follows through with his decision to lift Title 42 in May.
Due to the severity of the border crisis, the President should put the security of our nation before politics. He needs to strengthen our immigration laws rather than constantly undermine legal immigration and encourage migrants to cross the border illegally.
In addition to pressing the President to reverse his decision to lift Title 42, our letter requests a briefing from top Administration officials on their reasoning for suspending this essential public health protocol. We also request details regarding the federal government’s strategy to stop illegal immigration at our southern border.
For the sake of public health, the rule of law, and the safety and security of this nation, I urge President Biden keep Title 42 in place.
