Grothman Introduces Continuing Opportunities for People with Disabilities to Excel Act

Congressman Glenn Grothman (R-WI) has introduced the Continuing Opportunities for People with Disabilities to Excel Act. This legislation will stop a proposed rule from the Department of Labor (DOL) which could lead to the closure of Community Rehabilitation Providers (CRPs). This legislation is endorsed by A-Team USA, a grassroots organization that advocates for individuals with disabilities. 

On December 3, 2024, the DOL took action to phase out the issuance of 14(c) certificates. This rule, if finalized, would be devastating for families and CRPs around the country who rely on these certificates for functional employment opportunities. Without these certificates, individuals with disabilities could be forced into day services or worse, remain completely isolated at home.  

“I am proud to introduce the Continuing Opportunities for People with Disabilities to Excel Act. Under my bill, individuals with disabilities will be protected and empowered through the preservation of their right to choose the workforce program they think will best suit their needs,” said Grothman. “The rewards of being employed go far beyond just the employee, extending to the families of those with disabilities, the organizations they touch, and the entire surrounding community. Few things are more inspirational than seeing the pride of work that is evident in the men and women working in organizations like these.” 

 

Background 
Section 14(c), also known as Subminimum Wage or Commensurate Wage, is a provision in The Fair Labor Standards Act (FLSA) that upon receiving a certificate from DOL, permits employers to pay an individual with a disability commensurate wage. Under 14(c), the hourly wage for an individual is based on a productivity scale. In some cases, this can actually lead to an individual making more than the minimum wage. Having a steady job and earning a paycheck is a point of pride and the main benefit from these jobs is not the size of the paycheck, it is the feeling of belonging and interaction with their peers in a safe environment. These individuals deserve the dignity that comes from feeling productive and contributing to society, just like anyone else. It is also important that, through their jobs at CRPs, they establish friendships both with individuals similar to themselves as well as the management staff - friendships that last for years.
